
Our client, while walking in the crosswalk with the right of way, was struck by a turning cab driver and seriously injured. She brought a complaint at the Taxi & Limousine Commission. The Administrative Law Judge found that the driver had behaved recklessly, by failing to yield to her and an entire group of pedestrians. The driver was fined $1,400 and four points were placed on his hack license. The driver, owner and manager of the cab are already defendants in a separate civil suit, in which the TLC finding of reckless may well be binding upon the driver for purposes of civil liability.
