Judge Rules in Favor of Bike Accident Victim in Steel Road Plate Case

Ruling in favor of a Vaccaro & White client, a Judge will allow a jury to decide if two construction companies were negligent in causing a bike rider’s injuries.

Justice Kathryn Freed of New York Supreme Court denied the motions of two construction companies to be dismissed from a case brought by a cyclist who crashes on an improperly-ramped steel plate. New York City law requires that steel road plates be ramped around the edges with asphalt so as to ensure a “smooth ride,” but this is often not done.  A Vaccaro & White client had a bicycle accident and was injured on an improperly-ramped plate as shown.  Judge Freed held that a jury would be permitted to decide whether the two construction companies were negligent in causing the bike rider’s injuries.
